自(zi)然資源部(bu)近(jin)日(ri)出臺《地(di)質(zhi)勘查(cha)活(huo)動監(jian)督(du)(du)管(guan)(guan)理(li)辦法》(以下簡稱《辦法》),將對地(di)質(zhi)調查(cha)、礦(kuang)產勘查(cha)、地(di)質(zhi)災害調查(cha)評價和(he)危險性評估勘查(cha)設計等(deng)地(di)質(zhi)勘查(cha)活(huo)動加(jia)強監(jian)督(du)(du)管(guan)(guan)理(li),積極(ji)構(gou)建地(di)質(zhi)勘查(cha)單位(wei)自(zi)治、行業自(zi)律(lv)、社會監(jian)督(du)(du)、政府監(jian)管(guan)(guan)的社會共(gong)治格局(ju),進一(yi)步貫(guan)徹落實國(guo)務院“放管(guan)服”改(gai)革要(yao)求,加強地(di)質(zhi)勘查活動監督管(guan)理,促(cu)進地(di)質(zhi)勘查行業健康發展。  
《辦法》對各級自(zi)然(ran)資源主(zhu)管(guan)(guan)部門的職責和分工進行了明確劃分。自(zi)然(ran)資源部負責組(zu)織開展全國(guo)地質(zhi)勘(kan)查活(huo)動(dong)的監(jian)督(du)管(guan)(guan)理(li)工作,統(tong)一建設(she)“全國(guo)地(di)質(zhi)(zhi)勘查(cha)(cha)行業監(jian)管(guan)服務平臺”,組(zu)織(zhi)制定、修訂(ding)地(di)質(zhi)(zhi)勘查(cha)(cha)國(guo)家及行業標(biao)準(zhun)和技(ji)術規(gui)范,統(tong)(tong)籌地(di)質(zhi)(zhi)勘查(cha)(cha)單(dan)位情況統(tong)(tong)計工(gong)(gong)作(zuo),指(zhi)導(dao)推(tui)動(dong)(dong)全國(guo)地(di)質(zhi)(zhi)勘查(cha)(cha)技(ji)術鑒(jian)定與服務工(gong)(gong)作(zuo)。自(zi)治(zhi)區、直轄市自(zi)然(ran)(ran)資(zi)源(yuan)主(zhu)管(guan)部(bu)門負責本行政區內地(di)質(zhi)(zhi)勘查(cha)(cha)活動(dong)(dong)“雙(shuang)隨機、一(yi)公開(kai)”監(jian)督檢查(cha)(cha),組(zu)織(zhi)地(di)質(zhi)(zhi)勘查(cha)(cha)單(dan)位信(xin)息填報及公示,管(guan)理地(di)質(zhi)(zhi)勘查(cha)(cha)單(dan)位異(yi)常名錄和嚴重失信(xin)主(zhu)體名單(dan),調查(cha)(cha)處理地(di)質(zhi)(zhi)勘查(cha)(cha)活動(dong)(dong)有關投訴舉報事項,組(zu)織(zhi)制定、修訂(ding)地(di)質(zhi)(zhi)勘查(cha)(cha)地(di)方標(biao)準(zhun)和技(ji)術規(gui)范,組(zu)織(zhi)開(kai)展相關統(tong)(tong)計工(gong)(gong)作(zuo),指(zhi)導(dao)推(tui)動(dong)(dong)本行政區地(di)質(zhi)(zhi)勘查(cha)(cha)技(ji)術鑒(jian)定與服務工(gong)(gong)作(zuo),指(zhi)導(dao)市縣自(zi)然(ran)(ran)資(zi)源(yuan)主(zhu)管(guan)部(bu)門開(kai)展日常監(jian)督管(guan)理工(gong)(gong)作(zuo)。
《辦法》明確(que)地質勘查(cha)活動(dong)監管程(cheng)序(xu)和方式。省級(ji)以(yi)上(shang)自然資源主管部(bu)門要(yao)在門戶網站設(she)立“監(jian)(jian)(jian)管(guan)平臺”專欄,依法(fa)歸集共享地質勘查(cha)(cha)單(dan)位(wei)基本信息、地質勘查(cha)(cha)活動信息以及政(zheng)府監(jian)(jian)(jian)管(guan)信息,接(jie)受社會監(jian)(jian)(jian)督(du)(du)(du)。省級自(zi)然(ran)資(zi)源(yuan)(yuan)主(zhu)管(guan)部(bu)(bu)門(men)(men)應建(jian)立監(jian)(jian)(jian)督(du)(du)(du)檢查(cha)(cha)對象名(ming)錄庫(ku)和(he)監(jian)(jian)(jian)督(du)(du)(du)檢查(cha)(cha)人(ren)員名(ming)錄庫(ku),按照“雙隨(sui)機、一公開(kai)”的(de)方式開(kai)展監(jian)(jian)(jian)督(du)(du)(du)檢查(cha)(cha),并(bing)將(jiang)抽查(cha)(cha)結果在(zai)(zai)(zai)規(gui)定(ding)時間內進(jin)行(xing)公示。縣級以上自(zi)然(ran)資(zi)源(yuan)(yuan)主(zhu)管(guan)部(bu)(bu)門(men)(men)通過監(jian)(jian)(jian)督(du)(du)(du)檢查(cha)(cha)和(he)投訴舉(ju)報發現地質勘查(cha)(cha)單(dan)位(wei)違(wei)法(fa)違(wei)規(gui)情況的(de),應在(zai)(zai)(zai)核實后(hou)由省級以上自(zi)然(ran)資(zi)源(yuan)(yuan)主(zhu)管(guan)部(bu)(bu)門(men)(men)在(zai)(zai)(zai)規(gui)定(ding)時間內作出將(jiang)其列入異常名(ming)錄的(de)決(jue)定(ding),并(bing)責令其限期整改。
《辦法》對地質(zhi)勘查(cha)(cha)單位被列入異(yi)常名(ming)(ming)錄(lu)(lu)或(huo)嚴重(zhong)失(shi)信主(zhu)體名(ming)(ming)單的(de)情(qing)況進行了(le)明確規定(ding)。省級(ji)以(yi)上(shang)自(zi)然資源主(zhu)管部門(men)在作出(chu)將(jiang)地質(zhi)勘查(cha)(cha)單位列入異(yi)常名(ming)(ming)錄(lu)(lu)或(huo)嚴重(zhong)失(shi)信主(zhu)體名(ming)(ming)單的(de)決定(ding)前,應告知其擬被列入異(yi)常名(ming)(ming)錄(lu)(lu)或(huo)嚴重(zhong)失(shi)信主(zhu)體名(ming)(ming)單的(de)事(shi)由、依據和當事(shi)人依法享有的(de)權(quan)利。地質(zhi)勘查(cha)(cha)單位對被列入異(yi)常名(ming)(ming)錄(lu)(lu)或(huo)嚴重(zhong)失(shi)信主(zhu)體名(ming)(ming)單有異(yi)議的(de),可以(yi)自(zi)公示之日起20日內通過監管平臺向作(zuo)出決定的自(zi)然資源主管部(bu)門提出申(shen)訴。《辦法》明確,地質勘查單位被列入異(yi)常名錄之日起3年(nian)內,已按(an)要求(qiu)整改到(dao)位(wei)或已履行(xing)相(xiang)關義務的(de)(de),可(ke)向(xiang)作出(chu)決(jue)定(ding)的(de)(de)自(zi)然(ran)(ran)資源(yuan)主管(guan)(guan)部門提出(chu)核實申(shen)請,經自(zi)然(ran)(ran)資源(yuan)主管(guan)(guan)部門核實后,作出(chu)是否將(jiang)其(qi)移出(chu)異(yi)常名(ming)錄的(de)(de)決(jue)定(ding),并(bing)(bing)在(zai)監管(guan)(guan)平臺公(gong)示(shi);仍未按(an)規定(ding)整改或履行(xing)相(xiang)關義務的(de)(de),自(zi)然(ran)(ran)資源(yuan)主管(guan)(guan)部門應(ying)在(zai)核實后將(jiang)其(qi)列入嚴(yan)重失信主體名(ming)單(dan),并(bing)(bing)通(tong)過監管(guan)(guan)平臺公(gong)示(shi)。地(di)質(zhi)勘查單(dan)位(wei)對(dui)被列入異(yi)常名(ming)錄或嚴(yan)重失信主體名(ming)單(dan)有異(yi)議(yi)的(de)(de),可(ke)以自(zi)公(gong)示(shi)之日起20日內(nei)通過監管(guan)平臺向作出(chu)決定的自(zi)然資源(yuan)主(zhu)管(guan)部門(men)提出(chu)申(shen)訴。
《辦法》指(zhi)出(chu),自然資(zi)源(yuan)部(bu)可根(gen)據各地(di)實踐情況,指(zhi)導構(gou)建全(quan)國(guo)地(di)質(zhi)勘(kan)查(cha)活動技術鑒(jian)定與市(shi)(shi)場(chang)服(fu)務(wu)機制。各省級(ji)自然資(zi)源(yuan)主管部(bu)門應依托行業協會或公益性地(di)質(zhi)勘(kan)查(cha)單位,整合專家資(zi)源(yuan),指(zhi)導構(gou)建本行政區(qu)內地(di)質(zhi)勘(kan)查(cha)活動技術鑒(jian)定與市(shi)(shi)場(chang)服(fu)務(wu)機制,并加強業務(wu)指(zhi)導,相關鑒(jian)定結(jie)果可納(na)入監管平臺進行管理(li)。
